Buffalo/Yonkers, NY—Last week, August 7, the Thomas More Society filed a complaint in Federal Court on behalf of the Evergreen Association, EMC FrontLine of New York City and Summit Life Outreach Center near Buffalo. The lawsuit details how “[New York Attorney General Letitia] James has unconstitutionally chilled the speech of pregnancy help organizations across [New York], and “…how [AG] James is demonstrating a retaliatory animus against those pregnancy help organizations that share information about APR.” Letitia James recently filed a copycat lawsuit against several pro-life pregnancy centers, including firebombed CompassCare, similar to the lawsuit filed by California Attorney General Rob Bonta.
The Chicago-based law firm, the Thomas More Society, is representing the pro-life pregnancy centers, claiming Letitia James has used her office to violate the 1st and 14th Amendment rights of pro-life Christians, censoring the science regarding the safe and effective, pregnancy-sustaining progesterone therapy commonly called “Abortion Pill Reversal” (APR). Plaintiffs allege the AG’s lawsuit against pregnancy centers is chilling their speech, not being free to say what is true about the effectiveness of progesterone therapy in reversing the dangerous effects of chemical abortion.
Progesterone therapy is accepted by the FDA and is a vital therapy provided for free to women who choose not continue their abortion by pregnancy centers. Yet, the for-profit abortion industry is selling dangerous, chemical abortion with known and quantifiable morbidity and mortality rates without disclosing the serious risks and side effects, fraudulently marketing it as “safer than Tylenol.” Ironically, pro-abortion politicians are engaging in misdirection through frivolous lawsuits claiming that pro-life groups are the frauds.
Rev. Jim Harden, EMC FrontLine President, says, “James is illegally leveraging the power of her office to penalize Christians for communicating truth in violation of her ideology, not the law. Christian people associate and express the truth through pregnancy care that all people are created in God’s image, equally valuable—both mom and baby. Letitia James needs to be impeached and then indicted for conspiracy to deprive the religious liberty and speech rights of pro-life Christians.”
Peter Breen, Thomas More Society Executive Vice President & Head of Litigation, said, “Ms. James is on a witch-hunt to silence our pro-life ministries and shut down their constitutionally protected speech about Abortion Pill Reversal…Ms. James flagrantly violates their constitutional rights by using lawfare to silence those who disagree with her.”
The actions of Letitia James and Rob Bonta signal more than a threat to pro-life Christians. Rev. Harden expands, “Democrats have made abortion the pillar of their election efforts. Imagine if the Executive branch is claimed by the Harris-Walz ticket—Harris the former California AG, and Walz who is a fly-over communist. Undoubtedly, someone like AG James or Bonta will be appointed U.S. Attorney General. With Schumer (D-NY) remaining the Majority Leader in the Senate and the House likely to flip, making Hakeem Jeffries (D-NY) the Majority Leader, the Nation will be controlled by the communist states of California and New York.”
Rev. Harden warns, “Under U.S. AG Garland, the DOJ’s attacks on pro-life Christians have been limited to several dozen peaceful pro-life Christians. In NY and CA, the Attorneys General have made it their mission to silence all pro-life expression. If the Executive and Legislature are controlled by NY and CA communists, the Supreme Court will be stacked, opening the floodgates of persecution on conservative parents attending school board meetings, businesses that refuse to take part in homosexual events, pastors who preach pro-life sermons, and anyone who does not agree with the left’s Marxist agenda.”
